Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("User," "you") and NetherX ("we," "us," "our"). By adding the Bot to a Discord server, configuring it, or invoking any of its commands, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately remove the Bot and discontinue all use.

• You must be at least 13 years of age, or the minimum digital-consent age in your jurisdiction, whichever is higher.
• You must comply at all times with the Discord Terms of Service and Community Guidelines.
• Server administrators are responsible for ensuring all members of their server may lawfully interact with the Bot.

You may use NetherX to:

• Moderate and protect your Discord community.
• Use utility, automation, leveling, fun, and community-integration commands as documented.
• Configure the Bot through server-administrator-controlled settings.

You agree not to:

• Abuse, spam, flood, or rate-limit the Bot, its API, or its infrastructure.
• Reverse-engineer, decompile, exploit vulnerabilities, or attempt unauthorized access.
• Use the Bot to harass, dox, threaten, defraud, or harm any individual or community.
• Distribute malware, illegal content, sexually explicit content involving minors, or content that violates applicable law.
• Resell, sublicense, or commercially exploit the Bot or its features without prior written consent.
• Circumvent blacklists, bans, rate limits, or any technical restriction.

Violations may result in immediate, permanent termination without notice and may be reported to Discord Trust & Safety or law enforcement.

The Bot is provided on an "as is" and "as available" basis. While we target 24/7 uptime and a sub-30ms response time, we do not guarantee uninterrupted, error-free, or uninterrupted operation. Features may be added, modified, suspended, or discontinued at any time without prior notice.

All source code, branding, logos, command structures, written content, and visual assets associated with NetherX are the exclusive property of NetherX and protected by international copyright, trademark, and other intellectual-property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Bot solely as intended. No other rights are granted, expressly or by implication.

We reserve the absolute right, at our sole discretion and without prior notice, to blacklist any user or server, restrict access to features, remove the Bot from any server, or terminate access for any reason — including but not limited to violation of these Terms, abuse, exploitation, or actions that pose a risk to the Bot, its users, or Discord. Blacklisting decisions are final and may be appealed only via the official support server.

To the maximum extent permitted by law, NetherX, its developers, contributors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to loss of data, loss of profits, business interruption, server damage, or moderation actions taken via the Bot — arising out of or in connection with your use of, or inability to use, the Services. Your sole remedy for dissatisfaction is to stop using the Bot.

You agree to indemnify, defend, and hold harmless NetherX and its team from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising from your use of the Bot, your violation of these Terms, or your infringement of any third-party right.

We may update these Terms periodically to reflect new features, legal requirements, or operational changes. Material changes will be announced via the official support server and reflected in the "Last updated" date above. Continued use of the Bot after such changes constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with applicable international internet-services law, without regard to conflict-of-law principles. Any dispute arising under these Terms shall first be addressed informally via the official support server before any formal action is initiated.
